Terms of Service

§1. General Provisions

  1. These Terms of Service define the rules for using the SmartSet AI mobile application (hereinafter: "Application") and the provision of electronic services.
  2. The owner and operator of the Application is SmartSet AI (hereinafter: "Service Provider").
  3. Using the Application implies acceptance of these Terms of Service and the Privacy Policy.
  4. The Terms have been drawn up in accordance with Polish and EU law, in particular consumer rights and GDPR.

§2. Definitions

  1. Application — SmartSet AI mobile app available on iOS and Android devices.
  2. User — a natural person aged 16 or over using the App.
  3. Account — an individual user profile.
  4. Service — functionalities provided by the app, including AI workout plans.
  5. Subscription — paid premium access.
  6. Digital Content — data provided digitally, like AI recommendations.

§3. Terms of Use

  1. Using the application requires:
    • a device with iOS 15.0+ or Android 10.0+,
    • active Internet connection,
    • creating an Account.
  2. The User agrees to provide true data during registration.
  3. The User is responsible for maintaining the confidentiality of login credentials.
  4. Using the App unlawfully, violating third party rights or disrupting App functionality is strictly prohibited.

§4. Services and Functionalities

  1. The application offers:
    • generating personalized workout plans using AI,
    • automatic progression and load adjustment,
    • tracking workout history,
    • analyzing workout data and providing recommendations.
  2. Some functionalities may only be available within a paid Subscription.
  3. The Application does not constitute medical advice. AI recommendations are informational only and do not substitute a doctor's, physiotherapist's, or personal trainer's advice.
  4. The User uses the Application at their own risk and should adjust intensity to their health condition.

§5. Subscriptions and Payments

  1. Subscriptions are available in monthly or annual plans, according to the App pricing.
  2. Payments are processed via Apple App Store or Google Play Store.
  3. Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  4. Users can manage subscriptions in App Store or Google Play settings.

§6. Right of Withdrawal

  1. Consumers have the right to withdraw from the contract within 14 days without giving any reason.
  2. To exercise this right, the User should inform the Service Provider via email: contact@smartsetai.pl.
  3. If the User expresses consent to begin service provision before the withdrawal period expires, they may lose the right of withdrawal (Consumer Rights Directive).
  4. Refunds processed by App Store / Google Play are subject to their respective policies.

§7. Intellectual Property Rights

  1. The App, source code, UI, graphics, content, AI algorithms, and the name "SmartSet AI" are the intellectual property of the Service Provider.
  2. The User is granted a non-exclusive, non-transferable license for personal use.
  3. Copying, modifying, reverse engineering, or distributing any part of the App without permission is prohibited.

§8. Data Protection

  1. The Service Provider is the Data Controller.
  2. Data is processed in accordance with the GDPR (General Data Protection Regulation).
  3. Detailed information may be found in our Privacy Policy.

§9. Liability

  1. The Service Provider strives for continuous App operation but does not guarantee it.
  2. The Service Provider is not liable for:
    • damages resulting from improper use,
    • injuries or health deterioration resulting from suggested exercises,
    • App unavailability due to external factors.

§10. Contact and Complaints

  1. Complaints should be sent to: contact@smartsetai.pl.
  2. The Service Provider will respond within 14 business days.

§11. Final Provisions

  1. The Service Provider reserves the right to amend these Terms.
  2. The Terms come into effect on February 21, 2026.
